Terms and Conditions of the Online Store

§1 Preliminary Provisions

These Terms and Conditions are addressed to both Consumers and Entrepreneurs using the Store and define the rules for using the online store as well as the principles and procedures for concluding Sales Agreements with the Customer remotely via the Store.

§2 Definitions

Consumer – a natural person who concludes an agreement with the Seller within the Store, the subject of which is not directly related to their business or professional activity.

Online Store – operated by the Seller at www.nicecitytour.fr

Distance Contract – a contract concluded with the Customer within an organized system for concluding distance contracts (within the Store), without the simultaneous physical presence of the parties, using exclusively one or more means of distance communication until the conclusion of the contract.

Terms and Conditions – this document.

Order – a declaration of intent submitted by the Customer via the Order Form, aiming directly at concluding a Sales Agreement for one or more Products with the Seller.

Account – the Customer’s account in the Store, storing data provided by the Customer and information on placed Orders.

Order Form – an interactive form available in the Store allowing the placement of an Order, especially by adding Products to the Cart and defining the terms of the Sales Agreement, including delivery and payment methods.

Cart – a part of the Store’s software where selected Products for purchase are visible and where Order data can be modified, especially the quantity of products.

Product – a movable item/service available in the Store that is the subject of the Sales Agreement between the Customer and the Seller.

Sales Agreement – a contract for the sale of a Product concluded or to be concluded between the Customer and the Seller via the Online Store. It also includes – depending on the characteristics of the Product – a service agreement or a contract for specific work.

§4 Technical Requirements

To use the Store, including browsing the assortment and placing orders, the following are required:

a device with internet access and a web browser,

an active email account.

§5 General Information

To the maximum extent permitted by law, the Seller shall not be liable for disruptions, including interruptions, in the functioning of the Store caused by force majeure, unauthorized actions of third parties, or incompatibility of the online store with the Customer’s technical infrastructure.

Browsing the Store’s assortment does not require an Account. Orders can be placed without creating an Account, by providing the necessary personal and delivery details.

Prices in the Store are given in euros and are gross prices (including VAT).

The final price to be paid includes the Product price only.

§6 Delivery and Payment Methods

Available delivery or collection options:

Personal pickup at the address provided by the client (for rickshaw tours)

Personal pickup at the address specified by the seller (for other tours)

Available payment methods:

Cash on delivery (for reservations via WhatsApp)

Bank transfer to the Seller’s account

Electronic payments

Payment by card

§7 Execution of the Sales Agreement

The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order via the Order Form.

After placing the Order, the Seller shall promptly confirm its receipt and accept it for processing. Confirmation is sent via email and includes a statement of receipt, acceptance, and confirmation of the Sales Agreement. The Agreement is concluded upon receipt of this email by the Customer.

Start of delivery timeframe:

For payment via transfer, electronic payment, or card – at the date and time chosen by the Customer

For cash on delivery – from the date of conclusion of the Sales Agreement

For personal pickup – the Product will be ready at the time indicated by the Customer

Deliveries are limited to the center of Nice – French Riviera, France.

§8 Right of Withdrawal

The Consumer may withdraw from the Sales Agreement without giving any reason, up to 24 hours before the start of the booked tour.

The deadline is determined based on the scheduled service date.

To withdraw, the Consumer must submit a statement to the Seller. Sending it before the deadline is sufficient.

The statement can be sent via post, fax, email, or submitted through the Store’s website (contact details in §3).

§9 Complaints and Warranty

Complaints can be submitted in writing or electronically to the Seller’s contact addresses provided in these Terms.

It is recommended to include a brief description of the defect, the circumstances (including date), Customer’s details, and the guide’s details.

The Seller will respond promptly, no later than within 14 days. If no response is given within this period, the complaint is considered accepted.

§10 Personal Data in the Online Store

The administrator of personal data collected via the Store is the Seller.

Personal data is collected for the purpose of executing the Sales Agreement, and – if consent is given – also for marketing.

Recipients of personal data:

In the case of electronic or card payments, data may be shared with the payment processor.

The Customer has the right to access and correct their data.

Providing personal data is voluntary but necessary for the Sales Agreement.

§11 Final Provisions

Agreements through the Store are concluded in English.

The Seller reserves the right to amend the Terms for important reasons (e.g. legal changes, changes in delivery/payment methods). The Customer will be informed at least 7 days in advance.

In matters not covered by these Terms, generally applicable legal provisions shall apply.
